What do I do if I won?

Your first move is to contact the other person in the transaction. Sellers should try to contact the winning bidders within three business days after the auction ends. Winning bidders should also contact the sellers, especially if they haven't heard back from the seller within three business days. Sellers will not be offended if you show enthusiasm for the item that you bought. It is the responsibility of the seller and the buyer to contact one another.

Feedback

A Feedback Rating is a measure of a MenuUSA user's reputation in the community. Every registered user at MenuUSA has a Feedback Rating that is calculated by

Adding 1 point (+1) for each positive comment received.
Subtracting 1 point (-1) for each negative comment received.
Awarding 0 points (0) for each neutral comment received.
Even though a single person can give feedback on the same user multiple times, he/she will be able to affect that user's Feedback Rating by only one point.

Tips for Buyers

1. Know the item you bid on
If a description of an item is unclear, be sure to clarify the description with the seller before you bid.
If you're not sure what an item is worth, do a little research before you decide what you're willing to pay.
2. Check the seller's reputation

The number in parentheses next to a bidder's or seller's email address is that person's feedback rating—a tally of the comments other users have made about this seller.
Click on that number to see actual comments—and find out what this seller is like to do business with.

Changing the listing

Not getting the response you hoped for on your listing? Or maybe you've just had a sudden creative brainstorm! If no one has bid on your item, here's what you can do:
· You can change the title or description of your item.
· You can add or change an image or text.
· Or you can change the category your item is listed in.

· You can add text and pictures to your description.

Contacting other users

When buying or selling items, you often need to find out information about other people at MenuUSA. Any abuse of user information will not be tolerated and will result in suspension.
You can request contact information for another MenuUSA registered user by using the Registered User Information Request form. You will be sent an email message with the information. The information you request is sent via email in order to prevent abuse by non-registered users.
Keep in mind that the user whose information you are requesting will also receive your information. And, this information can only be used in matters regarding MenuUSA. Any other use is specifically prohibited.
You can also request information on other users' User ID history, as well as their email address, by using the User ID History and Email Address Request form. You can see whether they changed their User IDs, and what those previous User IDs were, or find out what their email addresses are so that you can email them.
You can see other information about other users. You can view others' feedback, and you can see what items they sell or bid on by using Search.

Creating an Auction


Once you register, it's as simple as clicking on the "Sell Your Item Now" button that appears to the extreme right of our upper navigation bar. You'll be asked to submit the following information for each auction:

Item title
Description
Picture (Optional)
Category
Minimum bid
Reserve price
Auction type
Duration of auction
Item location
Shipping terms
Accepted payment methods
Display features (Optional)
Be sure to include as much information as possible. The more that bidders know about an item, the more likely they are to place a bid!

Once you've provided all of the necessary information, you'll have a chance to double check your auction item page via a "Preview" button on the bottom of the form.

After confirming that your auction appears the way you wish it to, click the "Submit" button. Your auction is now live, and you can view it immediately on the detail page we'll list. Please note that as a courtesy to you, we delay listing your auction on our searchable index for up to 90 minutes so that you can make last-minute changes before bids occur.

Prohibited Content

MenuUSA.com Auctions adheres to a community standard that's probably about what you expect in your own community. Auctions should be fun for all involved, and they certainly should not be a minefield of inappropriate or illegal items. We want everyone to be comfortable with the content of the auctions we host.

Relisting the items

Typically, the majority of transactions on MenuUSA are completed successfully! But, if your item doesn't sell the first time around, all is not lost.
You can re-list your item one more time for free. If your item sells the second time around, you'll get the insertion fee for the second listing back. (If it doesn't sell this time, you will need to pay the insertion fee). Please make sure the following conditions apply:
· You didn't receive any bids on your listed item for a regular auction.
· You are re-listing the same item within 30 days of the closing date of the first auction.
· You didn't get any bids that met or exceeded your reserve price (for a Reserve Price Auction).
· You are re-listing the item with the same or lower reserve price.
Since this offer is only good for one re-listing, you'll want to make the second try a great one! You may want to come up with a different title, change the bid price, or add a more detailed item description. Check out the Tips for Selling Relisted Items for more ideas on how to make your second auction a success!
To re-list, go to the item page for your completed auction, and click on "now that the auction has ended, you can easily re-list this item by clicking here." Please be sure to enter the same (or lower) reserve price, because reserve price information will not be copied to the new listing.
After your item sells, you will be charged the applicable Final Value Fee.

Packaging and Shipping

Use iShip.com to provide your prospective buyers with an accurate shipping estimate — iShip makes it easy to offer shipping estimates during your auction, FREE! Just set a few preferences and iShip creates a custom link that you include in your item description. Prospective buyers can then click on the iShip link in your auction, enter their zip code and other preferences to view an accurate shipping rate.
In addition, to assist you with your packaging and shipping needs we have asked representatives from independent shipping companies to answer some common shipping questions and provide related shipping information.
Once you're ready to ship your item, consider using Mail Boxes Etc. for your packaging and shipping needs—MenuUSA users receive a special discount!
Ceramic Objects
Damage to ceramics is generally caused by shock. In order to minimize damage, ceramic objects need to be separated from each other and the outside walls of the carton and fully supported on all surfaces.
Adequate packaging techniques:
* Provision of at least 2" clearance between the object and the carton walls.
* Provision of cushioning material to protect from shock.
* Filling void in object (i.e. inside of vase) with paper-do not force paper so it is tight, but insert enough to help the object become more "solid"
* Separating each ceramic object when more than one is placed in a package.
* Restraining the object so that it can't impact carton walls or other merchandise.
* Over packing the original package, i.e. double boxing.
Inadequate packaging techniques:
* Product able to contact carton walls.
* Lack of separation between fragile ceramic items.
* Little or no cushioning against shock.
* Failure to restrain objects.
* Product too heavy for interior packaging.
* Not filling void in object.
Dishes/China
Adequate packaging techniques:
* A carton strong enough for the contents.
* Plates or dishes separated from one another (using single face corrugation or foam inter-liners).
* Product immobilized from movement in the container.
* Product separated from outside walls of the carton.
* Inventory list with damage noted should be included in each box, taped to the inside lid.
Inadequate packaging techniques:
* Selection of a carton too light or small for contents.
* Inadequate stacking/separation of components.
* Failure to properly stack/separate components.
* Lack of space between content and carton wall.
* Components move around when pack is shaken.
* Merchandise fills carton and is subject to compression.
Electrical Equipment, Stereos, TVs
Electronic equipment, together with retail packs for stereo, radio and TV sets are often shipped in the UPS system. Shipments for repair are also made by individuals, and often without the original adequate packaging. Besides the obvious need to protect the exterior case and faces of various electronics, the fragility of internal assemblies unseen under the surface must be considered.
Adequate packaging techniques:
* Molded Styrofoam suspensions.
* Custom corrugated die-cut suspensions.
* Air bubble wraps.
* Urethane foam pads and blocks.
* Take the time to 'tie down' loose appendages.
* Sturdy outside corrugated cartons.
* Mark cable connections with masking tape for ease of putting together for the consignee
* Remove any cassette tapes , CDs, etc from equipment
Inadequate packaging techniques:
* Device loose in a carton.
* No corner protectors.
* Components not secured to unit (Example: Stereo turntable and needle arm).
* Assembled devices shipped normally disassembled.
* Shipping carton not intended for product.
* Inadequate package closures.

Auction types

Ready to get the most out of your MenuUSA selling experience? Check out the As a seller, you can choose the type of auction that gets the results—and the price—you want! As a buyer, check out which auction type you'd like to try.
1. Reserve Price Auctions
Set a reserve price if you absolutely, positively won't sell below a certain price.
o Bidders know there's a reserve price, but they do not know what it is.
o In order to win the auction, a bidder must meet or exceed the reserve price and have the highest bid.
o If no bidders meet the reserve price, neither the seller nor the high bidder are under any further obligation.
o You can't use reserve prices for Dutch Auctions, and items with reserve prices are not displayed in the Hot Items section.
2. Private Auctions
Strictly hush, hush—use this auction to protect a buyer's privacy.
o Bidders' email addresses won't show up on the item or bidding-history screens.
o When the auction is over, only the seller will know who bought the item.
o This option can't be used with Dutch Auctions.
3. Dutch Auctions
This fast-paced, free-for-all format is perfect if you have multiple, identical items to sell.
o Sellers start by listing a minimum price, or starting bid, and the number of items for sale.
o Bidders specify both a bid price and the quantity they want to buy.
o All winning bidders pay the same price—which is the lowest successful bid. That might be less than what you bid!
o If there are more buyers than items, the earliest successful bids get the goods.
o Higher bidders get the quantities they've asked for.
o Bidders can refuse partial quantities.

4. Restricted-Access Auctions
This separate category makes it easy for you to find or avoid adult-only merchandise.
o To view and bid on adult-only items, buyers need to have a credit card on file with MenuUSA. Your card will not be charged.
o Sellers must also have credit card verification.
o Items listed in the Adult-Only category are not included in the New Items page or the Hot Items section, and currently, are not available by any title search.
o See the Adult-Only Terms of Use for more information.
o Please list adult items in the correct area. Otherwise, your auction may be relocated or ended. You could even be suspended from the site.
* Notice to Sellers of Adult Items
Various legal statutes regulate the sale and distribution of adult materials. As stated in the User Agreement, your breach of these laws is a breach of the User Agreement.

Minimum Bid

A minimum bid, which you stipulate, is the price at which bidding will begin. Unless you have set a reserve price, it is possible for a bidder to win your auction by meeting the minimum bid. In the absence of a reserve price, you are legally obligated to sell your item if your minimum bid has been met at the close of the auction.

How to sell

It's fun and easy to sell your stuff on MenuUSA! Here's how:
1. Simply fill out the form or click under Sell in the Navigation Bar on the MenuUSA home page. Choose a 3-, 5-, 7- or 10-day auction. Click on Sell Your Item, and you're in business!
2. Make your listing look great with linked pictures or fancy text. A short, descriptive title and a complete description of your item will also help your sales. But be truthful in your listings. Disappointed buyers are likely to leave you negative feedback.
3. Price to sell! Consider setting the minimum bid for your item a little lower than you think it will eventually sell for, just to get the auction going. Don't set it lower than you're willing to sell for, though. Be sure to clarify additional terms or expenses like who pays for shipping and insurance.
4. You can even advertise your auction. Just use this URL to point people to your auction: http://cgi.MenuUSA.com/aw-cgi/MenuUSAISAPI.dll?ViewItem&item=XXX (enter your assigned item number in place of the XXX).
5. Bidders or potential bidders might email you during the course of the auction. Don't hesitate to respond to all inquiries promptly.
6. Going, going, gone! When your auction ends, you and the high bidder will get emails. Auction results—the bidding history, final bid price and email addresses for the seller and the high bidder—are posted for 30 days.
The seller and the high bidder should contact each other within 3 business days at the end of the auction. You can contact the next-highest bidder if you can't conclude the transaction with the high bidder within 3 business days.
The winning bidder pays you directly for the item, and it's your responsibility to fulfill the order once payment terms are met. The binding contract of the auction is between the winning bidder and the seller.
Remember, an MenuUSA auction is a legal commitment to sell your item to the highest bidder. If you receive one or more bids above your minimum price, you are legally obligated to complete the transaction. A failure to do so is a breach of the User Agreement and may be legally actionable by one or more of the bidders. You have the right to cancel a transaction only under exceptional circumstances
You may auction any merchandise you have the right to sell, as long as it complies with the User Agreement and is not on the prohibited items list. Please list your item in the appropriate category. Adult items must be listed only in the adult section.

About authentication...
By authenticating and registering your item, you establish it as the real thing. Bidders can be sure it isn't a fake or forgery--and these are real concerns with some historic and collectible items.
The services we recommend not only authenticate items, they appraise them relative to all other items of their type. The grade varies according to the item--the condition of a coin may be scored on a scale of "1 to 100" for instance, while comic books are typically ranked from "poor" to "mint."

Auction types

MenuUSA.com Auctions offers three types of auctions:

Standard auctions
Dutch auctions
Private auctions
Standard Auctions

Standard auctions are by far the most common type--though each auction is exceptional in its own way. If you wish to sell a single item or a group of items to one high bidder, a standard auction is the one for you. You may set a reserve price with such auctions.

Dutch Auctions

In Dutch auctions, bidders compete for multiple quantities of a single item--five Barbie dolls, for example, or 20 rocks that bear a striking resemblance to George Washington.

Bidders submit both how many items they wish to buy and how much they want to bid for each one. The final per-item price in a Dutch auction is determined by the lowest of the winning bids. The bidder who submits the highest of the winning bids is entitled to the quantity he or she specified, but at the lower per-item price. Remaining quantities of the item are used to fill other winning bids in the order of their bid price. Confused? Reading this example should clear things up:

Joe and Sue (not their real names) are the individual high bidders in a Dutch auction for lamps. Joe placed a bid for 30 lamps at $20 each. In a subsequent bid, Sue offered to buy 10 lamps at $65 each. Because Sue's high bid ($65) is greater than Joe's high bid ($20), Sue is entitled to all 10 lamps she requested at the $20 price (the lowest winning bid). Joe is entitled to the remaining 20 lamps at $20 each, even though his original bid was for a quantity of 30.

There is usually more than one winner in a Dutch auction. Winners who are not the top bidder may win fewer items than requested in their original bids, but winning bidders are still bound to purchase the smaller number of items.

Private Auctions

Private auctions are the least common type of auction. Bidders are not identified during the auction process. Only the seller and high bidder are notified of the auction results.

Contacting other users

When buying or selling items, you often need to find out information about other people at MenuUSA. Any abuse of user information will not be tolerated and will result in suspension.
You can request contact information for another MenuUSA registered user by using the Registered User Information Request form. You will be sent an email message with the information. The information you request is sent via email in order to prevent abuse by non-registered users.
Keep in mind that the user whose information you are requesting will also receive your information. And, this information can only be used in matters regarding MenuUSA. Any other use is specifically prohibited.
You can also request information on other users' User ID history, as well as their email address, by using the User ID History and Email Address Request form. You can see whether they changed their User IDs, and what those previous User IDs were, or find out what their email addresses are so that you can email them.
You can see other information about other users. You can view others' feedback, and you can see what items they sell or bid on by using Search.

Auction types

Ready to get the most out of your MenuUSA selling experience? Check out the As a seller, you can choose the type of auction that gets the results—and the price—you want! As a buyer, check out which auction type you'd like to try.
1. Reserve Price Auctions
Set a reserve price if you absolutely, positively won't sell below a certain price.
o Bidders know there's a reserve price, but they do not know what it is.
o In order to win the auction, a bidder must meet or exceed the reserve price and have the highest bid.
o If no bidders meet the reserve price, neither the seller nor the high bidder are under any further obligation.
o You can't use reserve prices for Dutch Auctions, and items with reserve prices are not displayed in the Hot Items section.
2. Private Auctions
Strictly hush, hush—use this auction to protect a buyer's privacy.
o Bidders' email addresses won't show up on the item or bidding-history screens.
o When the auction is over, only the seller will know who bought the item.
o This option can't be used with Dutch Auctions.
3. Dutch Auctions
This fast-paced, free-for-all format is perfect if you have multiple, identical items to sell.
o Sellers start by listing a minimum price, or starting bid, and the number of items for sale.
o Bidders specify both a bid price and the quantity they want to buy.
o All winning bidders pay the same price—which is the lowest successful bid. That might be less than what you bid!
o If there are more buyers than items, the earliest successful bids get the goods.
o Higher bidders get the quantities they've asked for.
o Bidders can refuse partial quantities.
o Check out an example.
4. Restricted-Access Auctions
This separate category makes it easy for you to find or avoid adult-only merchandise.
o To view and bid on adult-only items, buyers need to have a credit card on file with MenuUSA. Your card will not be charged.
o Sellers must also have credit card verification.
o Items listed in the Adult-Only category are not included in the New Items page or the Hot Items section, and currently, are not available by any title search.
o See the Adult-Only Terms of Use for more information.
o Please list adult items in the correct area. Otherwise, your auction may be relocated or ended. You could even be suspended from the site.
* Notice to Sellers of Adult Items
Various legal statutes regulate the sale and distribution of adult materials. As stated in the User Agreement, your breach of these laws is a breach of the User Agreement.

Minimum Bid

A minimum bid, which you stipulate, is the price at which bidding will begin. Unless you have set a reserve price, it is possible for a bidder to win your auction by meeting the minimum bid. In the absence of a reserve price, you are legally obligated to sell your item if your minimum bid has been met at the close of the auction.

Relisting the items

Typically, the majority of transactions on MenuUSA are completed successfully! But, if your item doesn't sell the first time around, all is not lost.
You can re-list your item one more time for free. If your item sells the second time around, you'll get the insertion fee for the second listing back. (If it doesn't sell this time, you will need to pay the insertion fee). Please make sure the following conditions apply:
· You didn't receive any bids on your listed item for a regular auction.
· You are re-listing the same item within 30 days of the closing date of the first auction.
· You didn't get any bids that met or exceeded your reserve price (for a Reserve Price Auction).
· You are re-listing the item with the same or lower reserve price.
Since this offer is only good for one re-listing, you'll want to make the second try a great one! You may want to come up with a different title, change the bid price, or add a more detailed item description. Check out the Tips for Selling Relisted Items for more ideas on how to make your second auction a success!
To re-list, go to the item page for your completed auction, and click on "now that the auction has ended, you can easily re-list this item by clicking here." Please be sure to enter the same (or lower) reserve price, because reserve price information will not be copied to the new listing.
After your item sells, you will be charged the applicable Final Value Fee.
Note: This offer does not apply to Dutch Auctions.

What do I do if I sold my item?

So you've won your auction, or you've sold an item. Now what do you do?
Your first move is to contact the other person in the transaction. Sellers should try to contact the winning bidders within three business days after the auction ends. Winning bidders should also contact the sellers, especially if they haven't heard back from the seller within three business days. Sellers will not be offended if you show enthusiasm for the item that you bought. It is the responsibility of the seller and the buyer to contact one another.
When the auction has ended, sellers should contact the winning bidder(s) (usually within three business days) with information on the total cost, including shipping, and where to send payment. The winning bidder(s) pays the seller directly for the item(s), and it is the seller's responsibility to fulfill the order when payment terms are met. The binding contract of the auction is between the winning bidder and the seller.
A seller may contact the next-highest bidder if the seller is unable to conclude the transaction with the high-bidder within 3 business days. Packaging and Shipping

Use iShip.com to provide your prospective buyers with an accurate shipping estimate — iShip makes it easy to offer shipping estimates during your auction, FREE! Just set a few preferences and iShip creates a custom link that you include in your item description. Prospective buyers can then click on the iShip link in your auction, enter their zip code and other preferences to view an accurate shipping rate.
In addition, to assist you with your packaging and shipping needs we have asked representatives from independent shipping companies to answer some common shipping questions and provide related shipping information.

Ceramic Objects
Damage to ceramics is generally caused by shock. In order to minimize damage, ceramic objects need to be separated from each other and the outside walls of the carton and fully supported on all surfaces.
Adequate packaging techniques:
* Provision of at least 2" clearance between the object and the carton walls.
* Provision of cushioning material to protect from shock.
* Filling void in object (i.e. inside of vase) with paper-do not force paper so it is tight, but insert enough to help the object become more "solid"
* Separating each ceramic object when more than one is placed in a package.
* Restraining the object so that it can't impact carton walls or other merchandise.
* Over packing the original package, i.e. double boxing.
Inadequate packaging techniques:
* Product able to contact carton walls.
* Lack of separation between fragile ceramic items.
* Little or no cushioning against shock.
* Failure to restrain objects.
* Product too heavy for interior packaging.
* Not filling void in object.
Dishes/China
Adequate packaging techniques:
* A carton strong enough for the contents.
* Plates or dishes separated from one another (using single face corrugation or foam inter-liners).
* Product immobilized from movement in the container.
* Product separated from outside walls of the carton.
* Inventory list with damage noted should be included in each box, taped to the inside lid.
Inadequate packaging techniques:
* Selection of a carton too light or small for contents.
* Inadequate stacking/separation of components.
* Failure to properly stack/separate components.
* Lack of space between content and carton wall.
* Components move around when pack is shaken.
* Merchandise fills carton and is subject to compression.
Electrical Equipment, Stereos, TVs
Electronic equipment, together with retail packs for stereo, radio and TV sets are often shipped in the UPS system. Shipments for repair are also made by individuals, and often without the original adequate packaging. Besides the obvious need to protect the exterior case and faces of various electronics, the fragility of internal assemblies unseen under the surface must be considered.
Adequate packaging techniques:
* Molded Styrofoam suspensions.
* Custom corrugated die-cut suspensions.
* Air bubble wraps.
* Urethane foam pads and blocks.
* Take the time to 'tie down' loose appendages.
* Sturdy outside corrugated cartons.
* Mark cable connections with masking tape for ease of putting together for the consignee
* Remove any cassette tapes , CDs, etc from equipment
Inadequate packaging techniques:
* Device loose in a carton.
* No corner protectors.
* Components not secured to unit (Example: Stereo turntable and needle arm).
* Assembled devices shipped normally disassembled.
* Shipping carton not intended for product.
* Inadequate package closures.

Canceling bids

You can cancel bids in an auction if one or more of the following circumstances apply:
1. You have decided to end the auction
2. A bidder contacts you to back out of a bid
3. You can not verify the identity of a bidder after trying all reasonable means of contact
Please note: Cancellations are publicized in the auction bidding history, and you will be asked to explain your cancellation to bidders. If the cancellation was not legitimate, you are also likely to hear about it from other users.
Stop the Auction!
You may miss out on just the bid you have been waiting for if you end your auction early. Still, there may be times when you have a valid reason to end an auction. You may stop your auction when you decide not to sell. To do this, you must cancel all bids on your auction before it ends. If you do not do this, you are obligated to sell to the high bidder.

Not getting the response you hoped for on your listing? Or maybe you've just had a sudden creative brainstorm! If no one has bid on your item, here's what you can do:
· You can change the title or description of your item.
· You can add or change an image or text.
· Or you can change the category your item is listed in.
If your item has bids:
· You can add text and pictures to your description.
· Or, you can change the category in which your item is listed.
It's easy—just look at the "Update item" section of your listing to revise

This list is intended to give you a sense of the types of items that are not permitted for sale through MenuUSA. This list is updated from time to time and is incorporated by reference to the User Agreement. Notice for updates to this list will be posted on the Announcement board or similar service on the MenuUSA web site, the day of the change. Employee Policy

So, you are doing business with an MenuUSA user who is also an employee of MenuUSA. MenuUSA employees must follow strict rules to buy and sell on MenuUSA. Further, MenuUSA Inc. does not sponsor nor endorse employees’ buying or selling on the site. The following are the rules that all MenuUSA employees must follow to use MenuUSA services.
1. Any representation to buy or sell items by an MenuUSA employee is made solely for the employees own personal use and not on behalf of MenuUSA.
2. Employees of MenuUSA are held to the highest standards of conduct on our site. Employees are to abide by the MenuUSA Rules. Employees are subject to all the fees and policies for using the services of MenuUSA Inc.
3. MenuUSA employees must use a personal, non-MenuUSA email address to conduct business on MenuUSA. This email address must be registered on MenuUSA with a non-MenuUSA home address.
4. When an MenuUSA employee bids on an item, the employee must email the link to this web page to the seller, and when an MenuUSA employee lists an item on MenuUSA, the employee must include the link to this web page in their listing.
5. MenuUSA employees who have access rights on the MenuUSA system to reserve bid pages can never bid on reserve price auctions, and never bid within the last 24 hours of an auction.
6. MenuUSA employees are to conduct personal trading on the MenuUSA site only outside of their normal working hours.
